Az előreláthatósági elv megvalósulása a tíz éves bírói gyakorlat alapján

چکیده
A tíz éve hatályba lépett Munka Törvénykönyve a kártérítési felelősség területén markáns változtatásokat vezetett be, mely szerint munkáltatói alóli mentesüléshez az ellenőrzési körön kívüliség és előreláthatóság hiányának együttes bizonyítására van szükség. törvény lépésekor több szerző is kísérletet tett normaszövegben nem definiált fogalmak értelmezésére, emellett jogalkalmazás maga elvégezte ezt feladatot, ami során elsősorban jog reparatív preventív szemléletét szem előtt tartva szigorú (szűk kimentést engedő) értelmezését rögzítette.
